The following categories of persons shall be excluded from the Class:

1. officers, directors, employees of the Consumers’ Association and its subsidiary, Which? Limited, and trustees of the Consumers’ Association and connected persons thereto;
2. officers, directors or employees of Qualcomm Incorporated, its subsidiaries and any entity in which it has a controlling interest;
3. all members of the Consumers’ Association’s and Qualcomm Incorporated’s respective legal teams and all experts and professional advisors instructed and retained by them and all funders or insurers involved, in connection with the Collective Proceedings;
4. all members and staff of the Tribunal assigned to these Collective Proceedings; and
5. any judge involved in any appeal in the present Collective Proceedings (whether in respect of the grant of permission to appeal or the hearing of any substantive appeal).
